What's Legal In New York
Adults 21 and older can purchase and possess up to 3 ounces of cannabis flower or 24 grams of concentrated cannabis at any time outside of a private residence. Sales are restricted to licensed adult-use retailers (look for an OCM-CAURD license number). Personal home cultivation of up to 6 plants per adult (12 per household) is permitted. Public consumption follows the same rules as tobacco, generally a private residence, prohibited in parks and within 100 feet of schools.
How To Identify A Licensed Dispensary

Verify any license against the public Office of Cannabis Management database at cannabis.ny.gov. Licensed retailers also check ID at the door (21+ required), sell lab-tested products with full COA, and accept only cash, debit, or CanPay.
What's Legal Versus Unlicensed
The unlicensed smoke shops that proliferated in 2022 through 2025 are still being shut down by OCM. Unlicensed products are not lab-tested, not tax-paid, and frequently contaminated. Buying from licensed stores funds the state's social-equity programs (40% of cannabis tax revenue is committed to communities harmed by prohibition). It also protects you legally, only licensed product is protected under MRTA.
